Environmental Law

Our expertise in both judicial and administrative forums, as well as alternative dispute resolution, provides the necessary skill to win these environmental cases. The attorneys at Dughi, Hewit & Domalewski play a lead role in defending corporations identified as PRPs (potentially responsible party) by the U.S. EPA and N.J. DEP at many of the east coast’s toxic waste sites. We have acted on steering committees and have chaired allocation and negotiating committees within PRP groups involving hundreds of members/defendants. Our lawyers have negotiated and drafted Consent Decrees and site settlements with the U.S. EPA and N.J. DEP, as well as internal PRP group allocations and settlements. The firm has also litigated numerous insurance coverage matters for major corporations and negotiated dozens of agreements for insurance for environmental liabilities. The firm also provides routine environmental compliance advice in conjunction with real estate transactions and development. In particular, the firm’s environmental law practice includes the following:

  • Federal Superfund remediation and cost recovery claims and litigation
  • Business and transaction site investigation and risk assessment due diligence
